1. No statutory withdrawal right (business contracts)

1.1 TrackLog concludes contracts exclusively with entrepreneurs within the meaning of § 1 UGB and with legal entities under public law (see section 1.2 of the Terms). Contracts are not concluded with consumers within the meaning of § 1 KSchG.

1.2 The statutory right of withdrawal under the Austrian Distance and Off-Premises Selling Act (FAGG) is available only to consumers. Because TrackLog does not conclude consumer contracts, there is no statutory withdrawal right under the FAGG.

1.3 By ordering, the Customer confirms their status as an entrepreneur. Ending the contractual relationship is governed by the points below and the Terms.

2. Withdrawal before the contract is formed

2.1 The Customer's order constitutes a binding offer. The contract is formed only upon receipt of TrackLog's order confirmation or upon performance of the service (section 4 of the Terms).

2.2 As long as TrackLog has not confirmed the order or begun performance, the Customer may withdraw the order informally - for example by email to office@tracklog.at.

3. Ending ongoing contracts (termination)

3.1 Contracts for term services (platform and provision of Hardware under the subscription) are concluded for an indefinite period unless a minimum term is agreed.

3.2 They may be terminated by either party in writing with one month's notice to the end of a calendar month, unless otherwise agreed (section 15 of the Terms). An email to office@tracklog.at is sufficient for termination.

3.3 The right of extraordinary termination for good cause remains unaffected.

4. Defects: warranty instead of withdrawal

4.1 Independently of a withdrawal right, the Customer has the statutory and contractual warranty rights. Note the entrepreneur's duty to inspect and notify defects (section 8 of the Terms, § 377 UGB).

4.2 The warranty period for Hardware vis-à-vis entrepreneurs is twelve months from handover (section 9 of the Terms). Defects must be reported to office@tracklog.at.

5. Return of Hardware after the contract ends

5.1 GPS trackers (TrackLog T1) provided under the subscription remain the property of TrackLog System GmbH. The Customer must return the Hardware to TrackLog in proper condition within 14 days after the contract ends (section 14 of the Terms).

5.2 The Customer bears the cost of return shipment.

5.3 If return is not timely or the Hardware is returned damaged, TrackLog may invoice a lump-sum damages amount of 49.00 € per device. The right to claim further damage is reserved.
